I can not easily reproduce that. Which selection tool are you using ?
If you are using the free select tool and the selection is not closed and finalized then there is no selection and the layer is deleted.
Make your selection, hit the enter key to finalize the selection, make sure you have those 'crawling ants, then use delete.
