I forget the exact details but providing the Gnu license GPL https://www.gimp.org/about/COPYING is not infringed that is permissible. What is being sold is the physical DVD + any extras included on the DVD + cost of delivery.

Looking at their blurb, take their claims with a pinch of salt. For anybody coming across this post, the place to get Gimp is

http://www.gimp.org where you will get the latest version straight from the developers and it is free. (and free from possible malware)

There's no need to look for horns on a horse's head...

If there is an official, safe and free distributor, why take a chance on other sites?
